New FLSA Poster Required

Last week, the Wage and Hour Division of the U.S. Department of Labor published additional information related to the Providing Urgent Maternal Protections for Nursing Mothers Act (or PUMP Act). Specifically, a field assistance bulletin was released which includes public guidance and enforcement support information regarding employees’ right to pump breast milk at work.
As we previously shared, The PUMP Act was enacted in late 2022. The law is an amendment to the Fair Labor Standards Act (FLSA) and applies to employers with 50 or more employees. Those employers must provide reasonable break time for all employees (whether exempt or non-exempt) to express breast milk.
The PUMP Act did not have a major effect on Illinois employers; Illinois has been subject to a law that requires those with more than five employees to provide reasonable paid break time to express milk since 2018.
Regardless, all Illinois employers must now act because the federally required FLSA poster has been updated with PUMP Act information. Previous versions of the FLSA poster, including the August 2016 version, no longer fulfill the posting requirement and should be replaced.
